Board
meetings are held in several locations within the Municipal Building
at 5 Brophy Lane. Most boards hold one meeting per month. However,
circumstances sometimes require that several Planning Board or Board
of Adjustment meetings be scheduled to allow for extensive presentations
and testimony. |

General Powers and Duties:
Make and adopt and, from time to time, amend the
master plan for the physical
development of the Borough;
Administer the provisions of the Land Subdivision
and Site Plan Review ordinances
of the Borough in accordance with their provisions
and the Municipal Land Use Law;
Consider and report to the Municipal Council within
35 days after referral as to any
proposed development regulation submitted
to it, and pass upon other matters
specifically referred to the Board by the
Council;
When reviewing an application, grant approval of
a subdivision site plan or conditional
use to the same extent and subject to the
same restrictions as the Board of Adjustment;
Give site plan review and approval in accord with
standards set forth by state statute.

Powers Granted by Law:
The Zoning Board of Adjustments, in accordance with state
statute, are:
Hear and decide appeals where errors are alleged
in the enforcement of the zoning
ordinance by a Borough official;
Hear and decide requests for interpretation of
the zoning map or ordinance;
Grant a variance to allow a structure or use in
a zoning district restricted against
such structure or use, but only with the approval
of at least two-thirds of the Board;
Refer a zoning application to the Planning Board
for a report.
Appeals:
An appeal from any decision of the Zoning Board of Adjustment
approving an application
for development, pursuant to state statute, must be filed
within 10 days of the date of
publication the Boards decision. |

Open Space, Recreation, and Historic Preservation Committee
Meetings: Four times per year
Members: Two, plus three appointed officials
The registered voters of the Borough of West Paterson, as the borough was known in 2006, approved a referendum to establish, as per Ordinance #05-06, an annual levy at the rate of $ .01 per every $100 dollars of property value of real property located in the Borough and to annually appropriate that revenue for any or all the following purposes or any combination thereof:
• Acquisition of land for recreation and conservation purposes;
• Development of land acquired for recreation and conservation purposes;
• Maintenance of land acquired for recreation and conservation purposes;
• Preservation of historic properties, structures, facilities, sites, areas or objects and the
acquisition of such properties, structures, facilities, sites, areas or objects;
• Payment of debt service on indebtedness issued or incurred by the Borough for any of
the purposes set forth above.
Amounts raised by the levy pursuant to ordinance are deposited into the “Municipal Open Space, Recreation, and Historic Preservation Trust Fund”, which is an interest-bearing account.
By ordinance, the committe is comprised of five members that shall review, prioritize, and make recommendations to the Mayor and Council on the funding of qualifying projects. |

The Board is charged with the overall management of the surface water of the Passaic River and the Peckman River Basins. To do so, its members review potential acquisition, construction, financing, improvement, maintenance and operation of flood control facilities and make recommendations to the governing bodies of Cedar Grove, Little Falls and Woodland Park, along with other officials.
Additionally, the Board shall jointly purchase, construct, improve, extend, enlarge or reconstruct flood control facilities on behalf of its member local units subject to the approval of the council or governing body of each of the member municipalities.

Rent
Leveling Board
By ordinance, adopted March 1, 2006, the Municipal Council was granted all powers necessary and
appropriate to carry out and execute the purpose of this chapter including but
not limited to the following:
To issue and promulgate the rules and regulations establish in Ordinance #06-02, which
have the force of the law.
To supply information and assistance to landlords and tenants to
help them comply with
the provisions of the ordinance.
To hold hearings and adjudicate applications from landlords for
additional rental as
determined by in sections of the
ordinance. The Municipal Council must give reasonable
opportunity
to both landlord and tenant to be heard before making any
determination.
The Mayor is authorized to appoint and employ a Rent Leveling
Clerk whose powers
and duties are to be prescribed by the
Municipal Council.
Rental issues are to be handled by the Municipal Council, with an attorney appointed by
the Mayor who advises the Municipal Council.
